These terms and Conditions set out the basis on which you can use our website and place orders for goods by means of distance communication. By ordering in this way you are deemed to have understood and accepted these terms.

“Distance communication” means communication without the simultaneous physical presence of the supplier and the customer, e.g. by letters/ emails/ telephone conversations/ website orders. For the avoidance of doubt these terms will not apply in cases where any part of the contract has been negotiated or concluded face to face, for example by the customer visiting the showsite.

NON OF THE TERMS AND CONDITIONS SET OUT BELOW WILL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.

Making A Purchase

We accept Visa and MasterCard. GBP sterling and GBP cheques. You may send your credit card information via phone, fax, post, or securely over the Internet.   We require all monies to be paid at the time of placing your order.

Credit Card Security
All credit card numbers are encrypted in the shopping cart software when the order is placed. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

Tax Charges
For all orders 17.5 % VAT will be applied to the prices displayed on product pages. Customers in countries outside the European Union should email or call +44 1603 404080 to make alternative arrangements.

Orders
After your order enquiry Hamiltons will send to you a confirmation email, this is an offer to process your order on the terms contained within the email, including these terms and conditions.

A contract for the supply of goods is formed between you and Hamiltons at the time when you return the confirmation email as acceptance of the terms of the offer.

Should you accept our quotation for delivery contained within the email, a separate contract for the delivery service will also be formed at the time when you return the confirmation email, these terms and conditions will also be included within that contract.

The price(s) contained within our email will remain valid for 7 working days. Should you fail to confirm you wish to place the order, by returning the confirmation email, within that time the offer will lapse. However Hamiltons reserve the right to leave the offer open entirely at its own discretion.

Delivery Charges:
The cost of delivery will vary according to product type and distance. If you require delivery a quotation will be provided for you within the shopping cart prior to the processing of the order, alternatively the quotation may be provided to you by email, letter or fax prior to the processing of your order. Should you accept this quotation the delivery service will be a supplied under a separate contract and will be charged separately. For your convenience we will give you a total amount required in respect of supplying the goods and performing the delivery service which can be paid together. If you wish for the two amounts to be billed separately, or do not require delivery, please contact us to make alternative arrangements.

Delivery Schedule
Once you have returned the confirmation email we will begin to process your order. Hamiltons will perform its obligations within a maximum of 30 days. If this is not possible we shall inform you as to the reason why and agree an alternative timeframe with you. If it is not possible to agree an alternative timeframe we shall reimburse you any sum paid in relation to the contract. If time is of the essence this must be expressly stated at time of the initial order enquiry and confirmed as part of the confirmation email.

Delivery Date

Hamiltons will endeavor to inform customers as soon as possible of an approximate delivery date but shall not be liable for any losses as a result of not delivering at the indicated time.

Failed Delivery

All transactions are entered into on the understanding that the customer will be present and able to accept delivery of the products delivered to the specified delivery address on the date of delivery. If delivery fails because the customer is not present or is unable to accept delivery to the specified delivery address on the date of delivery an additional charge may be made by Hamiltons to cover the cost of repeat delivery.

Inspection upon delivery
It is the customer’s responsibility to inspect the goods at the time of delivery. Unless the goods are rejected at the point of delivery, and valid reasons for the rejection are communicated to Hamiltons, the customer will be deemed to have accepted the goods and confirmed that they are in good condition when delivered.

Product Images and Product Information
All product images are for general illustration of product type only. As wood is a natural product, visual variations in texture, grain, and colour are inevitable. All transactions are entered into on the understanding that the photographic image of a product is not precise and subtle differences are inevitable.
Some accessory images are for general illustration purposes only and the type supplied, relative to the products, may vary from the item shown.
The product information and prices on this website are as accurate as possible but the customer accepts that mistakes and errors can occur, and agrees not to hold Hamiltons and any third party updating or maintaining the website liable for any losses arising as a result of relying on any details displayed on our website. If you intend to rely on particular information expressed on our website you should make this expressly clear before placing your order, only once the details are confirmed in writing by Hamiltons and form part of the confirmation email will they become terms of the contract.

Substitution of goods

Hamiltons reserves the right, in the event of the goods ordered being unavailable, to provide substitute goods of equivalent quality and price. Hamiltons will meet the cost of returning any such substitute goods to us, in the event that you are not happy with them.

Board Lengths

Hamiltons reserves the right to supply any wood flooring orders in combinations of board length.

Your right to Cancel:
Subject to the conditions and exceptions below, you may cancel the contract within the cancellation period.

The cancellation period in relation to the supply of the goods begins with the day you confirm your order by returning the confirmation email and ends on the expiry of the period of seven working days beginning with the day after you receive the goods.

The cancellation period in relation to the delivery service begins with the day you confirm your order by returning your confirmation email and ends on the expiry of the period of seven working days beginning with the day after you confirm your order. If, with your agreement, performance of this service has begun within this period you will lose your right to cancel.

Notice of cancellation must be given in writing (whether by letter, fax or email) to Hamiltons at the contact details found at the bottom of this page.

Cancellation after delivery:
Should you wish to cancel the contract after the goods have been delivered, it is your responsibility to return the goods back to Hamiltons. The full order must be returned and received by Hamiltons in a new and unused condition and in the original packaging. Hamiltons may, entirely at its own discretion, agree to a part of the order being returned but this must be agreed in writing with Hamiltons prior to returning part of the order. Unless it has been previously agreed otherwise in writing, Hamiltons will not refund part orders or returned goods that are not in a new and unused condition.

In the event that you require Hamiltons to recover the goods you will be responsible for our charges not exceeding the direct costs of recovering the goods.

The cost of delivering the goods will not be refunded as this service has been completed.

Exceptions to the right to cancel – Special Orders

The right to cancel will not apply in relation to goods that are ‘special order’ for example goods that are made to your specifications, or personalised, or specifically ordered on your behalf, or which by reason of their nature cannot be returned. If goods you have selected are deemed to be ‘special order’ we will make you aware of this before the order is confirmed.

Exceptions to the right to cancel – Business Contracts

The right to cancel will not apply unless the customer is a natural person acting for purposes which are outside his business.

Privacy Policy

Hamiltons do not disclose customers’ information to third parties and your personal information will never be disclosed to any other party without your express consent. If you ask, Hamiltons will advise you by email about special offers and new products from time to time until you request that Hamiltons remove you from any list of customers so electing. You can do this at anytime by sending an email.

Cookies
Cookies are used on the shopping site to keep track of the contents of your shopping cart once you have selected an item and to store your details if you select the 'Store your details for future purchases' option in the shopping cart.
